Frequently Asked Questions
Title defects are among the most common sources of property litigation in India. A seller may not have clear ownership, the property may be under a mortgage, or there may be pending court cases affecting it. A thorough title search going back 30 years — examining registered deeds, encumbrance certificates, and revenue records — protects you from buying into an existing dispute.
The Real Estate (Regulation and Development) Act, 2016 makes it mandatory for builders to register their projects and maintain transparency on timelines, approvals, and fund usage. If a builder delays possession, changes approved plans without consent, or makes false representations, a homebuyer can file a complaint with the state RERA Authority and claim compensation or a full refund with interest.
Yes. NRIs and PIOs can purchase residential and commercial property in India under the Foreign Exchange Management Act (FEMA) without prior RBI approval. Agricultural land, plantation property, and farmhouses require special permission. Sale proceeds can be repatriated subject to FEMA conditions. We advise NRIs on compliant acquisition, proper power of attorney execution, and tax implications of Indian property transactions.
An Agreement to Sell is a contract between buyer and seller setting out the terms of the transaction — it does not transfer ownership. A Sale Deed is the final registered document that actually transfers title from seller to buyer. Under the Registration Act, 1908, a Sale Deed for immovable property must be compulsorily registered with the Sub-Registrar to be legally valid and enforceable.
You can file a complaint with the state RERA Authority seeking either possession of the unit with compensation at the agreed interest rate, or a full refund of the amount paid with interest from the date of each payment. RERA Authorities are bound to decide such complaints within 60 days. If the builder does not comply with the order, the matter can be escalated to the Appellate Tribunal and enforcement proceedings initiated. Contact us immediately — we will assess your case and advise on the fastest route to relief.
